Corby J. Lee v. State of Indiana

Criminal. Affirms Corby Lee’s conviction and sentence for murder in Allen Superior Court during a jury trial presided over by Judge Frances Gull. Finds that Lee has not sustained his burden of establishing that his sentence is inappropriate in light of the nature of the offense and his character. Also finds the trial court did not abuse its discretion in rendering its sentence. Attorney for appellant: Jamie Egolf. James L. Harness, IV v. State of Indiana
24A-CR-454
Criminal. Reverses Switzerland Circuit Court Judge W. Gregory Coy’s ruling that James Harness had earned only 45 days of accrued time and 15 days of good time credit for his pretrial home detention because Harness was in arrears on his home detention fees. Finds the trial court improperly deprived Harness of pretrial credit time. Also finds that the state has waived the opportunity to pursue deprivation of Harness’ pretrial credit time because the state never gave Harness written notice that he violated the conditions of his home detention by failing to pay fees. Remands with instructions that the trial court award Harness 245 days of accrued time and 82 days of good time credit for a total of 327 days. Attorney for appellant: Jennifer Joas.
