Parent sues after Lawrence Township school allegedly fails to provide medical help to child

The parent of a child who suffered an asthma attack at school is suing the Metropolitan School District of Lawrence Township and the school after school employees allegedly failed to provide medical help to the child during the incident.

The lawsuit was filed Monday in Marion Superior Court.

Representatives for the school district did not immediately respond to The Indiana Lawyer’s request for comment.

The attorney representing the plaintiffs declined to comment on the case.

In April 2023, the child, who was a student at Mary E. Castle Elementary School in the school district, allegedly suffered an asthma attack during recess.

According to court documents, despite notifying his teacher, employees at the school failed to follow the Asthma Action Plan, didn’t call 911 or notify medical personnel, and failed to administer emergency treatment.

Instead, school employees allegedly forced the child to lie down outside without providing medical help.

Instead of ensuring the child received the needed emergency medical care, school personnel allegedly put him on a school bus and sent him home without notifying his parents or emergency personnel, court documents stated.

When he got home from school, the child allegedly could not get off the bus and had to be carried off by his mother.

The child was then rushed to a nearby hospital and life-lined to an Indianapolis children’s hospital for admittance to the intensive care unit for oxygen deprivation.

The child’s mother is suing the school for negligence and requests compensatory damages and relief for the medical expenses that were incurred because of the negligence.

The case is A minor, by his parent and next of friend, Kenyetta Bradley v. MSD of Lawrence Township by and through its Superintendent & Board of Schools, Mary E. Castle Elementary School, 49D02-2504-CT-016392.
