Perry County didn’t pay woman’s wages, lawsuit alleges

A Perry County woman filed a federal lawsuit against her former employer last month alleging she was not paid her overtime or other wages following her termination.

Amber Wilson worked at the Perry County Recycling Management District until her termination in January.

The complaint alleges Perry County did not pay Wilbur her unused compensatory time, vacation time, personal leave time or sick time when she stopped working for them.

The complaint lists the counts against Perry County as failure to pay overtime wages pursuant to the Fair Labor Standards Act, Indiana’s Wage Claims statute and breach of contract.

Lastly, it alleges a 14th Amendment violation by Wilbur’s supervisor Kristine Wheeler. It claims Wilbur was terminated for false reasons that have affected her name and reputation.

Wheeler allegedly fired Wilbur for stealing money from Perry County, dealing drugs at work and falsifying her time records.

Wilbur is requesting the county be ordered to pay back pay with interest, front pay, compensatory damages, punitive damages and attorney fees along with demanding a jury trial.

She is also requesting injunctive relief in the form of having her job reinstated and restoration of all employment-related benefits with no loss of seniority.

Wilbur is represented by Ronald Weldy. According to the Southern District Court’s docket, the commission is representing itself.

The case is Amber Wilbur v. Perry County Board of Commissioners and Kristine Wheeler, 3:24-cv-113.
