Six apply for impending Allen County judicial vacancy

Three magistrate judges and three attorneys have applied for an upcoming vacancy on the Allen Superior Court bench.

Judge David Avery is retiring on Dec. 13, creating a vacancy in the civil division.

Avery has served on the bench for 24 years. He was appointed by Gov. Frank O’Bannon in 2000 and then re-elected four times.

The Allen County Judicial Nominating Commission is led by Indiana Supreme Court Justice Christopher Goff, which will be selecting finalists for the position.

The applicants are:

  • Michael A. Barranda
  • Magistrate Judge Brian D. Cook
  • Magistrate Judge Jason C. Custer
  • Magistrate Judge Michael Douglass
  • David M. Lutz
  • Kevin Mitchell

The commission will be holding interviews of the applicants on Sept. 25.

Following the interviews, the commission will consider the applicants in executive session and then vote publicly to select three nominees to send to Gov. Eric Holcomb for appointment. Holcomb will have 60 days to select Avery’s successor.

The person appointed will serve the remainder of Avery’s term, which ends Dec. 31, 2028.
