Plaintiff Shana Patz accused the Humane Society of being grossly negligent.
She is suing for damages incurred by the incident.
On Jan. 8, Patz was volunteering at the Humane Society when one of the dogs she was walking became aggressive and attacked her as she returned him to his kennel.
Patz lost her finger in the attack, the lawsuit states.
She argued the Humane Society was aware of the dog’s anxious and aggressive nature, and further, that they placed his food in a location that put Patz in harm’s way.
Patz said the Humane Society didn’t take the proper precautions to protect her from the dog. She also claimed the organization breached its duty to the general public by failing to ensure public safety.
Her husband, Dave Patz, is also a plaintiff in the lawsuit.
He said that as a result of the incident, he’s suffered the lost of services, society and marital rights out of his marriage with Shana.
Both plaintiffs seek judgment in an amount that will reasonably compensate for the losses and damages they incurred. They also requested a jury trial.
The Indiana Lawyer reached out to the Humane Society and Patz for comment, but did not hear back before IL’s deadline.
