DTCI: Flipping the Paradigm: Presenting Subsequent Remedial Measures as a Defense to Punitive Damage Claims against Motor Carriers
The legendary Green Bay Packers coach, Vince Lombardi, is credited with saying, “Hope is not a strategy.” The trucking industry and those who defend it need to move beyond merely hoping that the jury will be convinced that the plaintiffs have failed to carry their burden of proof on punitives. Recent verdict history shows that arguing that the conduct at issue “wasn’t that bad” often fails.

IndyBar Guest Column: Crisis Empowerment Grant Update (and a Plea for Day of Giving)
The Crisis Empowerment Grant Program was a wholesale success! More than 110 cases were settled and dozens of cases have been finalized and paid out. More than 40 cases are still active and the selected lawyers continue to work with their clients to assist with their legal issues.

The Indianapolis Bar Association’s Nominating Committee has announced the selection of Rebecca Geyer as the 2023 President of the Indianapolis Bar Association. Geyer will serve as the association’s First Vice President on the 2021 Board of Directors and as President Elect in 2022.

IndyBar: Frazzle, Dazzle, Rinse, Repeat
Let’s dispense with the pleasantries and get real. We are not OK. We are in the midst of a global pandemic, suffering through a highly contested presidential election, gearing up for another Supreme Court battle, the Pacific Northwest is on fire, the Eastern seaboard and Gulf Coast have been hit with so many hurricanes that they are using the Greek alphabet, we have all been forced to conserve toilet paper at some point in the last six months, and the cherry on top — many of us are educating our kids from home while working full-time jobs. What in the literal 2020 is happening? I honestly have no idea, but I have devised a three-part survival guide to get us through this.

Seeking unity: New ISBA President Michael Tolbert finds guidance for challenging times in service, family, faith
Michael Tolbert’s turn to lead the Indiana State Bar Association could not have come at a more challenging time. Having led multiple local bar groups, the Gary native takes the helm at the ISBA during a time of pandemic and persistent racial inequities that at times have put the law and lawyers on the defensive. Tolbert, though, is relentlessly optimistic.
ISBA offering in-person, virtual hybrid for annual meeting
The Indiana State Bar Assocation annual meeting will be a hybrid model allowing bar members to meet either virtually or in-person. Speakers will still offer CLE, sponsors will still share products and the House of Delegates will still meet. Perhaps most importantly, Hoosier lawyers will get the chance to reconnect after months of social distancing.
